Catholic boys’ school Xavier College is facing a multimillion-dollar lawsuit after a Supreme Court judge overturned a settlement struck to compensate the sick victim of a paedophile staff member.
Victorian Supreme Court judge Mary-Jane Ierodiaconou overturned the deed and criticised Xavier College because the school struck the deal while the victim didn’t have a lawyer, and did not tell him to report the matter to police. Ierodiaconou also sharply criticised the conduct of Father Michael Head, a college archivist and formerly Head of Professional Standards, who provided pastoral care to the victim and counselled him about his abuse.But, Ierodiaconou found, it was “troubling” that while Head acted as a confidant for the victim, he was also acting as an agent of the school when the deed was struck in the 2011 settlement.
