The family of Emerson Cole, an 11-year-old who died after having an allergic reaction at school, has filed a lawsuit against Amarillo Independent School District for alleged negligence. Cole’s mother, Chelsea Kroger Acosta, and grandmother, Carole Kroger, filed the lawsuit in the 108th District Court in Potter County last month, according to local media outlet MyHighPlains.com.
By the time Kroger made it to the nurse’s office, Cole was “struggling with a breathing treatment and collapsed,” the lawsuit says. The grandmother administered CPR until emergency workers arrived and took over treatment. Cole was treated for cardiac arrest, and an ambulance transported her to the hospital where she died two days later, on Jan. 19, 2023, as a result of anaphylaxis, according to court records.
