Black UofT student sues Toronto police over alleged assault, detention

, alleging officers threw him to the ground, pressed a knee to his neck, repeatedly shot him with a stun gun while he was restrained and wrongfully detained him, all as he pleaded that he had done nothing wrong.

A statement of claim filed in the Superior Court of Justice alleges 27-year-old Hasani O’Gilvie was assaulted by three Toronto police constables outside a North York grocery store on his way to class at the University of Toronto in August 2021. The claim, which has yet to be tested in court, alleges O’Gilvie was released after the officers searched his bag and found identification proving what he told police.

The parents are long time supporters and friends of Nigel Barriffe. Nigel is a professional anti-racism activist who is against police having tasers. This relationship needs to be considered in the events that lead up to the use of force and the decision to sue the police.

So can white people sue and claim the same? Why not? That's discrimination!

I hope the judge tosses their suit, otherwise being black and wrongfully-arrested will be like winning the lottery! Check that - I hope they win and the next time I’m wrongfully-arrested, I’mma identify as black and for some intersectionality bonus points, I’ll be ‘trans’, too!

UofT student suing Toronto police for $1.6M after he was allegedly Tasered with an officer’s knee on his neckA police officer’s knee was pinned against the neck of a University of Toronto student as he was repeatedly Tasered on the ground with his hands behind his head before his identification proved what he had told police – they had the wrong man, a statement of claim says. I believe it. It's tempting to zap someone into submission, go too far. Stats need to be collected any time officer uses Tasers, track personnel that over-use it, or in wrong situations. At least start collecting data. Bias exists; citizens shouldn't be injured while we dither. Did he politely and calmly comply with all the officer's requests until he could prove it was a case of mistake and identity? Police must be held accountable for using force beyond that which is deemed reasonable - more training needed -along with suspension and fine! Canada is a civilised country (we think) and doesn't need third world brutality in policing!
