A police officer’s knee was pinned against the neck of a University of Toronto student as he was repeatedly Tasered on the ground with his hands behind his head before his identification proved what he had told police – they had the wrong man, a statement of claim says.

He said he noticed a cruiser following him on Aug. 12, 2021. O’Gilvie, 27 at the time, was dropping by a North York plaza before catching the bus to the university’s downtown campus, according to a statement of claim.

O’Gilvie is suing the Toronto police and the three officers involved for the damages incurred on that summer day, along with $50,000 per Charter violation. His mother, Christine O’Gilvie, is also pursuing $250,000 in damages under the Family Law Act. “Mr. Ogilvie provided his full name but the Defendant Sergeant Saliba did not believe him,” the claim states.

“As the three Defendant officers piled on Mr. Ogilvie, the Defendant Constable Rietkoetter placed his knee and leg on Mr. Ogilvie’s neck,” the document alleges. “Young Black men, the impact of having a state authority attack you and all this is quite traumatizing. We suspect that these injuries will linger on for years and require a significant amount of treatment to resolve, if ever,” Shellnutt said.

I would have to see the body cam footage before coming to a full conclusion, but at the end of the day he was an innocent man. If what he alleges is true, then they gotta pay the man.

Judges, lawyers and cops are proof that there is no rule of law in Canada. They do things that would put normal people in jail or have consequences. Local media has ignored this problem ruthlessly and helped these bad actors stay hidden. For example:

The question here is use of force and did the police ascertain the victim is the right person? Was reasonable force used during the altercation. Hope justice is served.

Cops harassment is nothing new. It’s how they do their jobs. Guess what it happens to whites too but the media doesn’t care. I have a feeling when the body cam footage is released this guy loses.

First question I would ask if I was prosecution, what were you doing that they had to taser you ? Next question will be whether they just tasered you because of your ethnicity and for no other reason!

I believe it. It's tempting to zap someone into submission, go too far. Stats need to be collected any time officer uses Tasers, track personnel that over-use it, or in wrong situations. At least start collecting data. Bias exists; citizens shouldn't be injured while we dither. Did he politely and calmly comply with all the officer's requests until he could prove it was a case of mistake and identity? Police must be held accountable for using force beyond that which is deemed reasonable - more training needed -along with suspension and fine! Canada is a civilised country (we think) and doesn't need third world brutality in policing!
