IN one of my speaking engagements for school administrators, a school official asked me this question:

'Can the Department of Education overrule and substitute its own ruling of the resolution of a private school in a student discipline case?'No. As corporate entities, private educational institutions are inherently endowed with the right to establish their internal policies, academic and otherwise, unhampered by external controls or pressure.

These include the guidelines under DO 40, series of 2012, or the Child Protection Policy on the prohibition of corporal punishments on students. The school likewise cannot impose the extreme penalty of expulsion without the approval of the Secretary of Education.The department's mandate is to ensure compliance with quality standards that it sets upon educational institutions and to impose sanctions authorized by law, including school closures for their deficiencies or violations.
