TORONTO -- A bus company is on the hook for a $7 million award to a girl who suffered a brain injury when she jumped from a moving vehicle in keeping with an informal last-day-of-school tradition, Ontario's top court has ruled.
The incident happened on the last day of Grade 8 when Little and other students were on their way home from their area public school. She and her twin sister had ridden the bus for years and Sarah, as a bus patroller, knew how to open the emergency doors. On appeal, the company called for either a new trial or a reduction in the award. It argued Justice Elizabeth Quinlan made legal errors in her instructions to jurors, who should have put more blame on Little for what happened to her.
The Appeal Court did find Quinlan made a mistake in instructing the jury about whether Little had failed to lessen her pre-trial losses by having psychiatric treatment or by moving to a group home. However, the panel said the error was not material given the lack of evidence her prognosis would have been any different.
Girl is stupid that’s a given, but what about the judge that perpetuates this victim culture. Why is he a judge?
Litigation crazy world. Kids do foolish things, common sense went out the door that fateful day.
What the hell is wrong with people. You jump. You’re at fault. End of story.
IckyBiochemist well now I know what to do if I need money quick 🙄
Hopefully the company appeals .
As a parent of teen agers I truly sympathize with the family but I am struggling with understanding how the bus company could have stopped this from happening .
Here’s the new “style” school bus. Quit rewarding stupid!
Wait...what? How were they supposed to stop her from doing something so stupid?
Sensuously? Wow. The child did the act. Why is the bus company being held accountable. Yes I read the story, I disagree with the finding. 14 yr olds know better than to open a clearly marked emergency door and jump from a moving vehicle. Sorry.
