Boy (16) had ‘engaged in unpredictable aggressive and violent behaviour in the school’

A decision to expel a teenage boy with autism from the secondary school he had been attending, has been quashed by the High Court.Mr Justice Senan Allen ruled on Friday that the decision made in June confirming the teenager’s expulsion should be sent back for a fresh consideration.

It found that the school’s board of management’s decision was “reasonable in the view of the number of assaults and aggressive behaviours perpetrated by the teen towards himself, other students and staff at the school.” Through his mother, the teenager, represented by Feichin McDonagh SC claimed the committee’s decision was flawed.

In his judgment, Mr Justice Senan Allen said that the committee had found that the school board of management’s decision to permanently exclude the teen was reasonable.
