A New York school district is facing a big lawsuit over students' First Amendment rights, and seven major school districts in one state have policies in place to help children change their sex at school secretly without parents finding out.
"The district policies violate student's First Amendment rights because they discriminate based on the speaker's viewpoint," Sanzi said. "They compel students to affirm beliefs about controversial topics, whether or not they actually hold those beliefs. One example would be the topic of gender identity, and they also have codes of conduct or harassment policies that compel students' speech on these controversial topics.
"So what you have, you have students who now feel like they have to self-censor during the school day and even off-campus because these policies extend to students even when they're not on school grounds," she said. "We had filed public records requests to a bunch of districts in New Mexico just to get a sense of what their policies are on gender, because because what you just described is what we're seeing, you know, all over the country," Sanzi said. "I think we've documented now over 18,000 school districts serving 11 million students who have policies that say that if the child wants to change their gender, at school, that the school is not to let the parents know.
