Biden signed the legislation Wednesday, after it passed the House on Saturday and the Senate on Tuesday, requiring TikTok’s China-based parent company, ByteDance, to sell the app within 270 days, with an option for Biden to extend the timeline by 90 days if he sees “significant progress” toward a sale.The legislation was tacked on to the $95 billion foreign aid package Congress approved this week that will deliver more funding to Israel, Ukraine and Taiwan.
TikTok was widely expected to file legal action against the potential ban after its CEO Shou Zi Chew promised users in a video last month the company would “continue to do all we can, including exercising our legal rights, to protect this amazing platform that we have built with you.” Chew, in a new video posted to the app Wednesday, indicated the company could challenge the law in court on the grounds that it is a violation of First Amendment rights, telling users “this is actually ironic, because the freedom of expression on TikTok reflects the same American values that make the United States a beacon of freedom.”“Make no mistake, this is a ban,” Chew said. “Rest assured, we aren’t going anywhere. We are confident, and we will keep fighting for your rights in the courts.
