Protests on college campuses against the war in Gaza are continuing to spread across the country and creating difficultto navigate when it comes to protecting free speech rights and preventing hateful speech that leads to violent behaviors.
Calls for Columbia’s president, Nemat Shafik, to resign have grown in recent days as the student protesters have refused to disperse the encampment and led to the arrests reigniting a debate over where schools need to draw the line between protecting free speech and Jewish students who feel threatened.
“The law does not require universities to protect students from offensive speech in general. But to the extent students intimidate or harass other students, the university is obligated to intervene,” said Timothy Zick, a professor of law at William & Mary Law School and author of“Universities are trying to walk a fine line as they balance free speech and campus safety.”
But she is facing pressure from both sides of the aisle to come to a resolution with protesters in the encampment. Rep. Virginia Foxx, R-N.C., who chairs the Education Committee conducting hearings on campus protests,earlier this week calling for the expulsion of students and termination of faculty involved in the protests.
