A Hays CISD bus carrying 44 pre-K students and 11 adults from Tom Green Elementary School crashed with a concrete truck on State Highway 21 in Bastrop County, resulting in at least two fatalities and multiple injuries. last month has filed a lawsuit against the truck driver who struck the bus and the company he worked for.
It alleges Jerry Hernandez was negligent when he crossed over the center line into oncoming traffic and struck the school bus, causing it to roll over, on State Highway 21 in Bastrop County. The crash resulted in injuries to the plaintiffs and dozens of passengers. Two people died in the crash -- pre-K student Ulises Rodriguez Montoya and 33-year-old Ryan Wallace.
It also alleges that FJM Concrete Pumping, LLC was negligent after failing to properly train, monitor, and audit their driver, Jerry Hernandez.This morning, on behalf of my clients whose lives have been shattered by the Hays CISD bus crash of March 22, 2024, my staff and I have filed a lawsuit in the Bastrop County District Court.
Since the onset, we have been working closely with law enforcement — local, state, and federal — as well as numerous private, and governmental agencies to clarify the events of March 22nd and the circumstances that led up to this tragedy. We are thankful for the enthusiastic cooperation we have received.
