Classmates tried to get the boy to be 'socially inappropriate,' while school officials did nothing, the lawsuit alleges.

The boy was enrolled at Lyndhurst Middle School during the 2021-2022 school year for sixth and seventh grades with an individualized education plan, or IEP, according to court documents. The next day, the mother reported the incident to a guidance counselor who serves as the middle school’s anti-bullying specialist.

The same student also allegedly used a racial slur to greet the boy in the lunchroom. When the student was questioned by the school’s anti-bullying specialist, he allegedly said he uses the slur in a friendly way to say “hello to his friends,” according to the suit. On Dec. 2, 2022, the mother received letters from the district stating that each of the incidents were “not substantiated” and not acts of harassment, intimidation and bullying, the suit says.
