U.S. District Judge J. Philip Calabrese ruled Monday in favor of CSU student Aaron Ogletree, who challenged the use of web cams to scan the area where students take online tests.

A judge ruled Cleveland State University's use of room scans during online tests are unconstitutional.CLEVELAND, Ohio— A federal judge said Cleveland State University’s video search of a student’s bedroom before an exam violated the student’s privacy rights and amounted to an unconstitutional search.

The use of online tests skyrocketed during the coronavirus pandemic, when many schools went to online-only classes and test-taking.“Room scans go where people otherwise would not, at least not without a warrant or an invitation,” Calabrese wrote. Other students can see the room scans of others taking the same test. The room scans are recorded and stored by the school’s third-party vendor that oversees the tests.
