A mum of two is adamant that she will only send her daughter back to primary school when she is double vaccinated despite the threat of legal action for poor attendance

Lisa Diaz has said she will only send her daughter, Helena, back to school when she is double vaccinated

She also pulled her son, Alex, 12, out of his school during the first wave but sent him back around three weeks ago after he had both jabs. ‘There’s no masks and there’s no ventilation apart from opening the windows, weather permitting. In Belgium, they have introduced a rule about kids wearing masks aged six plus yet there are big issues about masks here, which I don’t understand.

Mrs Diaz, 40, has been sent a letter by Wigan Council saying Helena’s ‘poor attendance record’ could land her a fine of up to £2,500 and might also lead to family court proceedings. ‘I really don’t want to go to court for protecting myself and my family in a pandemic but the risk assessment doesn’t mitigate the risk of transmission to the lowest practical level and nor has it been updated in light of Omicron, so I’m not sure if that will stand up in court.’

Mrs Diaz told Metro.co.uk no one in her family has contracted Covid since the beginning of the pandemic, but the spread of Omicron is giving her fresh cause for concern. She is mindful of her own health condition, a blood clotting disorder named Factor V Leiden.

Deregister from school then you won't get fined, I did this with my youngest and home schooled as myself and eldest are CV x

She should deregister from school and home school like I did with my 9 year old as me and my eldest are CV x

We have kept our son out of primary twice now with cases in his class. Avoided it so far, but feels like it's getting close. Yesterday he took facemask to school, was told he can't wear it. Funny as in September he'll be at high school and they'll be nagging him to keep it on!

Home schooling is a legal option in the UK. It just needs a statement to be signed. No more threats. It’s their choice.

I have been shocked at the lack of protection of children & clinically vulnerable families. There should be various educational options available including remote education or school with better protections in place.

Good for her. There should be choice regarding schooling in a pandemic (similar to that offered in some US states), not forced attendance. I recently read that 1 in 24 young children are currently infected, so schools are clearly not Covid-safe. This mum is doing the right thing.

LCWF_TBK If I were still a governor I'd be advocating masks in all situations in schools as well as supporting vaccinations. Wearing a mask in a corridor but not while in a crowded classroom is just plain stupid. Rules made by idiots.

Thank you for highlighting, as parent I’m shocked how little has been done to protect children (&staff/families of both) from infection in most state schools, children’s primary school in chaos again with many pupils &staff on 2nd infection, shocking, taken mine out too!

I was talking to a taxi driver the other day who doesn't want his New York family Christmas trip to be cancelled. He'd been given a special spray for under a tenner from his colleague that cleans the air. Schools don't have to close they just have to be made safe. SafeEdForALL

Legal action but they’d be quite happy if you disappeared off quietly. This is about attendance stats and making sure everyone keeps sending their kids into school to be DELIBERATELY infected with covid. Bullies. Thank you so much for continuing to fight x

Go you, well done for protecting your children.

I think all fines about attendance in schools should be cancelled during this pandemic. They are probably doled out by people not believing in it and think that natural immunity will conquer all. If the child does the schoolwork properly that should be ok.

Good for her! Covid plagues UK schools and nothing is being done about it. We need to keep our kids safe at school.

Mum's always knows best. This looks like they are happy and content.

Send her to private school. She would be better off anyway.
